Later this year or early next year, SCOTUS will be hearing a case called Moore V. Harper. This case involves election laws and voting rights.

Every 10 years, a census is conducted in the United States. The data from this census is used to draw the political districts of states. 

North Carolina did this after the most recent census, but people sued saying that these new political districts were gerrymandered to favor one political party, thus violating North Carolina’s constitution. The NC Supreme Court agreed that these political districts were in fact gerrymandered in favor of one party and the map of political districts was redrawn. 

Tim Moore, a legislature in North Carolina, has said, per Independent State Legislature Theory, that this ruling is a violation of The U.S. constitution.

Tim Moore believes that legislatures have the power to gerrymander their states in a way that will take the voting power from opposition and give power to very few people, making one part dominant. This actively violates checks and balances, giving state legislatures the ability to subvert elections (like presidential ones).

There will be no limits to their power. 

Your votes will no longer matter because state legislatures will have the ability to turn an election in their favor. 

We know that state legislatures actively try to pass laws that will disenfranchise POC. Most recently, a voter ID law was blocked in North Carolina after being cited as discriminatory. Through Moore v. Harper, legislatures will ensure that this disenfranchisement will happen, meaning that POC will be even more disproportionately affected by the removal of voter protections and racial gerrymandering. 

If SCOTUS rules in favor of Moore, it can mean the end of democracy as we know it. 

But, we can still do something to stop this. 

One of the biggest things we can do is contact Tim Moore and tell him to drop his case ASAP or file a motion to dismiss. When calling, we need to make sure that we are as polite as possible so that our messages are not deleted.

If you live in North Carolina, make sure you VOTE in November. You can also visit him in person at his office (the address and contact info is all public information). 

Pressure your representatives and democrats to do something about this! 

Lastly, protest! Spread the word so that we can all try to prevent Moore V. Harper from becoming precedent. 

Four SCOTUS judges have given indication that they support parts of Independent State Legislature Theory and it’s possible they could rule in Moore’s favor. 

Right now is the time to ACT if you care at all about democracy in the United States. No matter your party, you should be concerned when democracy is threatened.
